Photography reserve the right to, from time to time, change these Terms at its sole discretion. By using this Site after any such change, you agree to comply with, and be
bound by, the Terms as changed.

This Site as a whole, and all material on this Site, is protected by copyright and other intellectual property rights. See separate copyright and trademark notice for further
1. ONLINE DATE:
Data published online refer to those provided by the makers and distributors. Photo images and data may slightly vary from the original.
Notices, including but not limited to, claims, legal notices, orders (in case of malfunctioning of the ordering system) as well as general remarks shall be sent to: email@example.com
3. ORDER CONFORMATION:
An email confirmation is sent to the buyer within 24 hours following the purchase order (Sundays and holidays not included). Should the order confirmation not match
the order, the buyer must inform James Pepper Wedding Photography within 48 hours (Sundays and holidays not included). Failure to do so implies approval from
Prices can be modified at any time. Prices upon purchase apply. Previously offered discounts, lower prices or any other special seasonal prices cannot be claimed
retroactively. James Pepper Photography will use all reasonable endeavours that the goods displayed are available at the prices shown. However, circumstances over
which James Pepper Photography has no control may occur - such as political or economic situations in the manufacturer’s country -and affect delivery or price in a
significant way. In these cases, James Pepper Photography cannot be held accountable and will duly inform the buyer at the specified address to make a decision upon
Items are selected online and dropped in the cart. Orders can only be made on the Internet. If the online ordering system should not work for what ever reason, an
order can be made via: firstname.lastname@example.org You must give the reference number of each picture (Photo), how many you require of each picture (Photo) and what size.
All orders you are placing are for the digital downloaded copy of the picture and not the hard copy photo.
Payment of a wedding is performed by bank transfer or cheque. Payment for goods through the James Pepper Photography website should be through the payment
method provided on the site. Goods are delivered only after payment is confirmed.
• Any weddings outside of Hampshire and West Sussex maybe subject to additional costs.
• A £450 non-refundable deposit is required on confirmation of your wedding booking. Any deposit can be moved to another date subject to availability.
• Remainder of any wedding booking fees are to be paid in full no less than one month prior to your wedding date.
The client will need to provide meals for the photographers and one assistant if attending during the time when the dinner is being served to the wedding guests.
These may be served in the dining room or at another location in the reception venue.
A full day wedding package will be up to 10 hours from start to finish and a half day wedding package will be up to 5 hours from start to finish. Any working hours
outside of these hours will be charged at £250 per hour. No exceptions.

10. WHO OWNS THE COPYRIGHT ON PHOTOGRAPHS:
Under law, it is the photographer who will own copyright on any photos he/she has taken, with the following exceptions:
If the photographer is an employee of the company the photos are taken for, or is an employee of a company instructed to take the photos, the photographer will be
acting on behalf of his/her employer, and the company the photographer works for will own the copyright.
If there is an agreement that assigns copyright to another party.
In all other cases, the photographer will retain the copyright, if the photographer has been paid for his work, the payment will be for the photographer’s time and
typically an allocated number of prints. The copyright to the photos will remain with the photographer, and therefore any reproduction without permission would be
an infringement of copyright.
If Bill Smith asks Peter Jones the photographer to photograph his wedding. Peter Jones will normally provide a single copy of the prints or disc as part of the fee, but any
additional prints Bill or his family and friends want must be ordered via Peter as he is the copyright owner and controls who can copy his work.
If Bill Smith engages the services of XYZ-Photos for the same job, and Peter is an employee of XYZ-Photo who instruct Peter to take the photos, XYZ-Photos will be the
copyright owner and control how they are used.
The Clients hereby allows the photographers to display any photograph covered by this contract and to generally promote the James Pepper Photography business in
advertising, brochures, websites, magazine articles and other such material, providing that the images used are used lawfully and without damage to The Clients.
13. NON COMPETE CLAUSE:
Family and friends of the client shall be permitted to photograph before, during, and after the wedding as long as they shall not interfere with the photographer's duties.
James Pepper Photography does not object to other reasonable photography occurring during the event as long as it does not keep James Pepper Photography from
fulfilling this agreement and professionally covering your event. James Pepper shall be the exclusive paid professional photographer retained by the client for the
purpose of photographing the wedding preparations, wedding ceremony, formal and informal portraits, and the wedding reception. The Client shall be responsible
for notifying anyone offering photography services of this clause and also enforcing this clause.
MATERIAL IN THIS SITE MAY CONTAIN INACCURACIES OR TYPOGRAPHICAL ERRORS. JAMES PEPPER PHOTOGRAPHY IS NOT LIABLE OR RESPONSIBLE FOR
ANY INACCURACIES OR ERRORS, OR FOR ANY LOSS OR DAMAGE CAUSED BY OR ARISING FROM ANY USER’S RELIANCE ON INFORMATION OBTAINED FROM
OR THROUGH THIS SITE. IT IS YOUR RESPONSIBILITY TO EVALUATE THE INFORMATION AND OTHER CONTENT AVAILABLE THROUGH THIS SITE. THIS SITE

POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION UNDER CONTRACT, TORT OR UNDER ANY OTHER THEORY, ARISING OUT OF OR IN
CONNECTION WITH THE USE, INABILITY TO USE, OR PERFORMANCE OF THE INFORMATION, PRODUCTS AND MATERIALS ON THIS SITE. BECAUSE SOME
JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OR ALL OF THE

17. FORCE MAJEURE:
a: The due performance of the contract is subject to alteration or cancellation by The Photographers owing to any cause beyond their control (i.e. sudden illness/injury).
b: The Photographers have other professional photographers who will be contacted by their staff (or family) in the event that they are not able to attend your booking due to clause 17a.
c: In the event of cancellation by The Photographers (although all attempts will be made to arrange for another photographer to be present – see clause 17b) or in the
unlikely event of total photographic failure (although re-shoots may be arranged if practicable – The Photographers will not be responsible for costs in order to stage such
re-shoots), The Photographers liability shall be limited to a full refund of any deposits and fees paid.
18. GOVERNING LAW:
Any contract made between The Photographers and The Clients shall in all respects be governed by and construed in accordance with UK Law and the parties here to
submit to jurisdiction of the UK courts.
In the unlikely event of any complaint with regards to our services, all complaints must be received in writing within fourteen days of collection of products purchased.

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND HAD AN OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE PRIOR
TO AGREEING TO IT. IN CONSIDERATION OF JAMES PEPPER PHOTOGRAPHY AGREEING TO PROVIDE THE WEDDING PHOTOGRAPHY (CONTENT), YOU AGREE
TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE
AGREEMENT BETWEEN YOU AND JAMES PEPPER PHOTOGRAPHY.
